Affiliate Program

1. PROGRAM OVERVIEW

Welcome to the Hydrasoft Technologies Affiliate Program! Our program allows individuals and businesses ("Affiliates") to earn instant commissions by bringing clients to Hydrasoft Technologies's services. Commissions are paid after successful client payment.

By participating, you agree to abide by this policy and our Terms & Conditions. Our goal is to create mutually beneficial partnerships with Affiliates who share our commitment to delivering exceptional digital solutions.

2. ELIGIBILITY

2.1 Who Can Apply

To join, you must:

• Be at least 18 years old
• Have a valid bank account or M-Pesa account for commission payments
• Reside in a country where affiliate marketing is legal
• Have a platform to promote our services (website, blog, social media, etc.)
• Agree to comply with all applicable laws and regulations

2.2 Restricted Parties

You cannot participate if you are:

• A Hydrasoft Technologies employee or immediate family member
• A current client referring yourself
• Engaged in illegal activities
• A competitor of Hydrasoft Technologies

2.3 Application Process

Apply by sending your details to [email protected]. Applications are subject to review and may be rejected at our discretion.

3. COMMISSION STRUCTURE

3.1 Commission Rates

Affiliates earn commissions based on the following structure:

3.2 Commission Calculation

Commissions are calculated based on net revenue received (excluding taxes, refunds, chargebacks, and discounts).

3.3 Minimum Payout

Minimum payout: KES 5,000. Balances below this roll over to the next month.

Note: There is no referral code. Affiliates simply bring clients to Hydrasoft and earn commission upon successful client payment.

4. REFERRAL TRACKING

Affiliates get commission by bringing a client that completes payment. Commissions are instant upon completion of client payment.

If multiple affiliates refer the same client, commission goes to the affiliate who contacted us first regarding the client.

5. PAYMENT PROCESS

5.1 Schedule

Paid monthly by the 15th of the following month. Only for completed projects with full client payment.

5.2 Methods

We offer the following payment methods for Affiliate commissions:

• Bank transfer or M-Pesa for Kenyan affiliates
• PayPal for international affiliates

5.3 Taxes

Affiliates are responsible for reporting income to tax authorities.

6. AFFILIATE RESPONSIBILITIES

6.1 Marketing Guidelines

Affiliates must adhere to the following marketing guidelines:

• Represent Hydrasoft Technologies accurately
• Disclose the affiliate relationship
• Avoid spamming, false advertising, or misleading claims

6.2 Prohibited Marketing Practices

The following marketing practices are strictly prohibited:

• No cookie stuffing, fake reviews, bots, or fraudulent methods
• No use of Hydrasoft trademarks in domain names or impersonation

6.3 Compliance with Laws

Affiliates must comply with all applicable laws, including but not limited to data protection laws, advertising standards, and competition laws in their respective jurisdictions.

7. INTELLECTUAL PROPERTY

We grant Affiliates a limited, non-exclusive, non-transferable license to use our marketing materials, logos, and trademarks solely for the purpose of promoting our services within the Program. This license terminates immediately upon termination of affiliate status.

Affiliates may not modify our logos or trademarks without permission, use our intellectual property in a way that suggests endorsement beyond the affiliate relationship, or register domain names containing our trademarks.

8. TERMINATION

8.1 Termination by Affiliate

Affiliates may terminate their participation in the Program at any time by providing written notice to [email protected]. Upon termination, the Affiliate must immediately remove all Hydrasoft Technologies marketing materials from their platforms.

8.2 Termination by Hydrasoft Technologies

We reserve the right to terminate any affiliate relationship at our sole discretion, with or without cause, by providing written notice. Grounds for termination may include, but are not limited to violations of this policy or inactivity.

8.3 Effects of Termination

Upon termination:

• All rights and licenses granted to the Affiliate will immediately cease
• The Affiliate must remove all links and marketing materials
• Earned but unpaid commissions are paid if valid
• Future referrals are not compensated

9. LIABILITY AND INDEMNIFICATION

Hydrasoft Technologies is not liable for indirect, special, or consequential damages arising from the Program or an Affiliate's participation in it.

Affiliates agree to indemnify and hold harmless Hydrasoft Technologies against claims from violation of this policy.

10. MODIFICATIONS TO THE PROGRAM

We reserve the right to modify this Affiliate Program Policy, commission structure, or any aspect of the Program at any time. Affiliates will be notified of material changes via email at least 30 days before they take effect. Continued participation after changes constitutes acceptance of the modified Policy.

11. DISPUTE RESOLUTION

Any disputes arising from this Program shall be resolved through good faith negotiation between the parties. If resolution cannot be reached, the dispute shall be settled through arbitration in Nairobi, Kenya, in accordance with Kenyan law.
